Where there is a change in the registered particulars of the licensee, a notice is required to be given to the Registrar of Companies (performing the role of Registrar of Money Lenders) in writing within 21 days after the change. There is no prescribed / specified forms for reporting the changes. You can send a letter to the Money Lenders Section of the Companies Registry and a copy to the Commissioner of Police (Licensing Office) to report the changes.
You can conduct a search (free of charge) on the "List of Existing Money Lenders Licensees and List of Applications for Money Lenders Licences" at this website under "Major Services > Licensing of Money Lenders > Searches > Search on Licensed Money Lenders" section. The Lists are also available at the new e-Services Portal (www.e-services.cr.gov.hk) under “Search > Licensed Money Lenders > Lists of Licensed Money Lenders”.
Starting from 27 December 2023, searchers should access the e-Search Services on the e-Services Portal to conduct searches electronically on the Register of Money Lenders upon payment of a fee of HK$17. Copies can be obtained at HK$6 per page.
The existing search services on paper files of registered particulars of licensed money lenders at the Money Lenders Section on 13th floor, Queensway Government Offices, 66 Queensway, Hong Kong have ceased after 5:00 p.m. on 22 December 2023 (Friday).
A licensed money lender is required to comply with the obligations to report changes of registered particulars under the Money Lenders Ordinance (Chapter 163 of the Laws of Hong Kong). For a licensed money lender who is a company, it is required to deliver Form ND2A/ND2B to report changes of directors in accordance with the requirements of the Companies Ordinance (Chapter 622 of the Laws of Hong Kong).
It is an offence if a licensed money lender fails to notify the Registrar of Companies (performing the role of Registrar of Money Lenders) of any change in its registered particulars within the prescribed time period. The offender is liable to a fine of HK$100,000 and to imprisonment for 2 years, if convicted.
